The EU passed a law. A company in California changed its global product.
Literal meaning: The Brussels Effect describes the mechanism by which EU regulation becomes the effective global standard for a sector — not through international treaty or diplomatic pressure but through the commercial logic of market access: companies that want to operate in the EU market must comply with EU rules, and compliance is often more economical as a single global standard than as a market-by-market variation.
Origin: The concept was developed and named by Columbia Law School professor Anu Bradford in a 2012 Columbia Law Review article and expanded in her book The Brussels Effect (2020). Bradford documented that EU regulations on privacy (GDPR), food safety, chemicals (REACH), and digital markets had become de facto global standards — not because other governments adopted them but because the global market leaders adjusted their products to EU requirements and extended those adjustments globally.
The mechanism by which EU regulatory standards spread globally — because companies find it cheaper to apply one standard everywhere than to maintain separate versions.
The Appeal: The Brussels Effect demonstrates that effective regulation of global technology companies is possible from a single jurisdiction with sufficient market power. GDPR’s data protection requirements, the Digital Services Act’s content moderation obligations, and the AI Act’s risk-based framework all have global reach through this mechanism. For advocates of technology governance, it is the most practical available path.
The Friction: The Brussels Effect is not a complete solution. CLOUD Act creates a direct conflict: US law requires US cloud providers to provide data to US authorities on request, regardless of where the data is stored — which conflicts with GDPR’s data protection requirements. The conflict creates a structural tension in any EU organisation using US cloud infrastructure. Vendor Lock-in is compounded by the regulatory complexity: organisations that have built their infrastructure on US cloud platforms face both technical and regulatory lock-in. The Brussels Effect sets floors but does not address power asymmetries in the markets it regulates.
The Digital Services Act adds a second route to global reach that does not depend on a company’s own cost calculation at all. Supervision of the largest platforms sits with the European Commission, but everything below that threshold falls to the national regulator of the country where the company’s European representation is established. Roblox is not classified as a very large platform, and its European representation is Dutch, which puts a platform used daily by tens of millions of children under the Autoriteit Consument & Markt. When the ACM opened a formal investigation on 30 January 2026 into harmful content, adults approaching minors, and the use of Dark Patterns to encourage purchases through Robux, it was deciding on behalf of the entire European market. Here the Brussels Effect runs through a single national authority rather than through a company concluding that one worldwide standard is cheaper than several.
That reach comes at the cost of speed, and a comparison makes the trade visible. In August 2026 the Australian regulator eSafety obtained a court-enforceable undertaking from the same company: signed on 17 August, accepted on 19 August, binding for three years, with named deadlines and an independent auditor paid for by Roblox. Concrete changes follow within three months. The Dutch investigation opened in January and is expected to take around a year, so an outcome lands somewhere in 2027. The European instrument is slower and broader, and it is the only one of the two that examines commercial manipulation of children at all.
Why This Matters: Brussels Effect names the most consequential mechanism of global technology governance currently in operation. Once you see how it works — EU market access as regulatory lever — you can read EU digital regulation as having global scope, and assess its adequacy accordingly.
